Could this be one of your Bathgates? (Found just putting Simon Bathagte into the search facility of the NAS online catalogue.
Reference Title Date CS228 Court of Session: Unextracted processes, 1st arrangement, Adams-Dalrymple office 1664-1868 Country code GB Repository code 234 Repository National Archives of Scotland Reference CS228/C/30/22 Title John Alexander Burn Callender of Westerton and Prestonhall v Simon Bathgate, tenant, Currielea, Crichton parish, Midlothian: Count reckoning and payment Dates 1863 Access status Open Description Summons claiming that the defender must lodge correct books and accounts showing the true amount of Lordship due under his lease. Level File
Photocopies of the items in the catalogue are available but can be quite expensive. If you are able to visit the NAS, 'phone first to check that the papers will be available as some papers are stored elsewhere and it takes a couple of days for them to get them to the search room for you. You can then read through them at no charge and make notes. You need a readers ticket but this is free and can be issued on the day. See their website for the identification that you need to get a readers ticket.

I am sure that you will collide with many more brickwalls before you are done! It took me 17 years to verify that I had the correct family for my husband's grandfather - he had a fairly common Scottish name and was illegitimate and he made up a father's name on his first marriage entry! The one thing you do learn from researching is patience.
I wonder if this could be the Simon on the NAS records?

Hi,
iam not sure if the 1st simon is him, as his estimated birth date on the 1841 census was age 40, so he would have been born about 1800.
I will look into the bottom simon ( simons father) as he is estimated to be born about 1807 and may have married Agnes as his second wife ( Maybe????).
Thank you again for taking your time to look into this for me.

Wondering if any of these are related to your Simon?
No Surname Forename Date Description Type Court Reference

EDIT
Tina, remember that ages of adults were rounded down to multiples of 5 years in the 1841 census. So someone whose age was given as 40 could have been born between 1797 and 1801.
