Until he/she has been dead for 70 years, then copyright doesn't apply, except under exceptional circumstances - like Peter Pan.

It is permissable to quote from copyright material providing the source is identified and given credit for the work.

Copyright belongs to the author. But...if an excerpt is used, it must be credited to that author. If it isn't THEN it is a breach of copyright law.

If the author has been dead for more than seventy years, there is no longer any copyright law surrounding the work of that author.

THAT'S real life copyright law. Daff credited that poem to the author, but she didn't have to, as copyright is out of date, ie, the author has been dead for more than seventy years.

Answering my own question: , "Names, titles, short phrases and colours are not generally considered unique or substantial enough to be covered, but a creation, such as a logo, that combines these elements may be.

For literary, dramatic, musical or artistic works
70 years from the end of the calendar year in which the last remaining author of the work dies.

If the author is unknown, copyright will last for 70 years from end of the calendar year in which the work was created, although if it is made available to the public during that time, (by publication, authorised performance, broadcast, exhibition, etc.), then the duration will be 70 years from the end of the year that the work was first made available."


"Typographical arrangement of published editions
25 years from the end of the calendar year in which the work was first published."

So Draco's in the clear lol. however 'Harry Potter' might not be ( creation of JK Rowling)

And you can see that Daff's post is clearly a quote. Therefore no breach of copyright is involved.

Picking on Daff-no,yes she is a very agreeable person & I had no intention of causing her any upset but she shouldnt call people names.
