I am just re-kindling interest in my family tree after an absence of about a year and have found a marriage on my husband's side that is puzzling me. Details are as follows:-
Thomas Lay Fairwether married Elizabeth Schmidt - Q3 1880 6a 126 (Bristol)
there is also a date of marriage for the above - Q2 1883 11a 15 (Chepstow)
There is only one birth for a Thomas Lay Fairwether is registered between 1850 - 1860.
If anyone has any idea why these two people would have to marry twice I would be grateful for your input.

There are about 2 reasons for a second marriage for a marriage like this


Something was wrong with the first marriage ................ ie, not the correct church, in a registry office, one of the participants was already married.

In this case, I wonder if Elizabeth was too young and did not have parental approval?? She is only 19 on the 1882 record.

I cannot find another record for the first marriage, other than on freebmd, ie, I can't the same record under those Gloucestershire CofE records


The other reason is that the groom was in the army and had not received his colonel's permission to marry beforehand. The army then considered that marriage illegitimate, and the couple shad to re-wed after getting the necessary permission.

Tks for your reply. 1883 was a typo it should have been 1882.
Have the details you have stated but if its just a matter of registration why would banns be posted again in 1882 if the first marriage took place in 1880.

The second marriage must have had to take place because there was something wrong with that first marriage.


I think you have to buy the first marriage certificate to find out.

If she really was 19 in 1882, then she could have been 16 or 17 when they married in 1880 ....... legal with parental or guardian permission, but not without that.

This seems to be him in 1881, not married. He's a dentist, same as on marriage record.

He was in a boat on the water and having trouble raising the sail. About an hour after someone saw that, the stern of the boat was seen to be sticking up out of the water. Thomas Fairweather's body was found in 16' of water

Thomas had recently bought the boat, was not experienced and was unable to swim

Verdict:- Accidentally drowned.

A tree on Ancestry shows his marriage in 1880, Bristol but the same tree shows him on the 1881 census as single and living with his parents.
