Just to let you all know, I rang GRO in Southport today. I decided to order Richard & Mary's Marriage Cert.
I also asked the woman about James, i explained about not finding him on Free BMD. She told me some of the free sites are incomplete, thats why i couldnt find his birth. The woman told me, that they could look for a Cert for him, so i gave her details of date. If no cert is found i will get a full refund, it was an offer i couldnt refuse.
A rellie of James's brother William, who is on GR is gonna send me a copy of Williams Birth Cert. I will send her a copy of Richard & Marys Marriage Cert!!!

Thanks Again for all your help Everyone

This is from the Devon County Council site which explains why a lot of births were not registered:

1837-1874

On 1st July 1837, the recording of births, marriages and deaths began. The country was divided into Registration Districts, each under the control of a Superintendent Registrar.

When civil registration was introduced, it was the responsibility of these Registrars to see that births and deaths were registered in their own sub-districts. Each Registrar gathered these records from the sub-districts and sent copies to the Registrar General in London, four times a year.

Births

Note that parents were not bound to give birth information unless requested by the Registrar. Some were not truthful about the date of birth, as they had to pay if the registration was more than 6 weeks after the birth. Some parents thought baptism was a legal alternative

try ordering the birth cert for William. You have a fairly precise qtr of birth and the only one that fits is this one

Births Dec 1880 (>99%)
Mainwaring William Liverpool 8b 2

Non Registration of births carried no penalty until 1875 (I think) so only Henry and William appear to be registered. Apparently Liverpool was well known for non-registration of births before that date

Order Thomas Mainwaring birth cert ...

--------------------------------------------------------------------------------
Births Dec 1870 (>99%)
--------------------------------------------------------------------------------

Mainwaring Thomas W. Derby 8b 362

--------------------------------------------------------------------------------

Thomas would be 3 months old on the 1871 census which this birth will be right for him..

It will confirm the parents names and mother's maiden name.
