"The High ( not Supreme Court) ed. was quite correct in ruling that the Sovereign's right to prorog parliament was not justicable. However this ruling rested on there being a valid reason for prorog. ( see C18 Statute Law, Erskine May ) and the parties telling the truth. From the Scottish Court hearing it appears that Johnson did not have a valid reason and the reason he gave as fictitous.

It is somewhat difficult to see the Supreme Court over ruling the Scottish decision next week as there is abundant evidence of his mendacity. In that case Johnson's administration will be on extremely thin ice through which it may well fall.

Given that all of the senior members of the government were aware of the scheme from mid August under English law they are as guilty as Johnson and could well be excluded from office along with Johnson himself.
