And you can see that Daff's post is clearly a quote. Therefore no breach of copyright is involved.

Mind your blood pressure Ron, it must be going through the roof by now.

Answering my own question: , "Names, titles, short phrases and colours are not generally considered unique or substantial enough to be covered, but a creation, such as a logo, that combines these elements may be.

For literary, dramatic, musical or artistic works
70 years from the end of the calendar year in which the last remaining author of the work dies.

If the author is unknown, copyright will last for 70 years from end of the calendar year in which the work was created, although if it is made available to the public during that time, (by publication, authorised performance, broadcast, exhibition, etc.), then the duration will be 70 years from the end of the year that the work was first made available."

"Typographical arrangement of published editions
25 years from the end of the calendar year in which the work was first published."

So Draco's in the clear lol. however 'Harry Potter' might not be ( creation of JK Rowling)

TheBlackKnight

TheBlackKnight Report 23 Mar 2010 16:00

Except when the Publisher maintains Copyright after death of the Author.

TeresaW

TeresaW Report 23 Mar 2010 16:00

YOu wanna argue Ron?

Copyright belongs to the author. But...if an excerpt is used, it must be credited to that author. If it isn't THEN it is a breach of copyright law.

If the author has been dead for more than seventy years, there is no longer any copyright law surrounding the work of that author.

THAT'S real life copyright law. Daff credited that poem to the author, but she didn't have to, as copyright is out of date, ie, the author has been dead for more than seventy years.

Until he/she has been dead for 70 years, then copyright doesn't apply, except under exceptional circumstances - like Peter Pan.

It is permissable to quote from copyright material providing the source is identified and given credit for the work.

Copyright-real world LAW.

It is an offence to perform any of the following acts without the consent of the owner:

Copy the work.

Rent, lend or issue copies of the work to the public.

Perform, broadcast or show the work in public.

Adapt the work.

The author of a work, or a director of a film may also have certain moral rights:

The right to be identified as the author.

Right to object to derogatory treatment.

Rambling Report 23 Mar 2010 15:53

If copyright laws are meant to apply here, as they are...then how come 'Draco Malfoy' is using that name without crediting JK?

hmmm Admin might want to check THAT out :))

TeresaW Report 23 Mar 2010 15:39

Nope, he was referring to my post stating Eldrick is an ordinary member of GR like me or him...trying to twist my words so they mean something else. Dont' worry, he wouldn't have come back with anything if I'd said it about anyone else, and he's so wrapped up in his dislike of Eldrick at the moment, he can't see what's under his nose.

TeresaW

TeresaW Report 23 Mar 2010 15:29

NO T&C's broken in Daff's post, as she had fully credited the poem to that book. It's only an infringement of copyright law if Daff had printed that as her own. Besides, I believe the author has been dead for more than seventy years, therefore no copyright applies.

Nice try Ron.....but you're way wrong there.

As for name calling....err.....where? Stating a fact about someone is not name calling.

TeresaW Report 23 Mar 2010 14:46

Ron, are you for real?

Isn't that paranoia at it's worst, thinking that Eldrick actually works for GR. That has got to be the funniest thing I've read in years.

Get a life! He's just an ordinary member like you or me.

Draco's nasty post on Saturday night was removed within minutes of being reported, are you going to credit Eldrick with that too? Or perhaps it was the abuse team doing their job. Fancy that eh?

If a public internet forum is making you this paranoid Ron, I suggest you switch off and make one of those phone calls you have to make, to your GP. Get help.

Your post was removed because it was against T&C's. Not by Eldrick, but by the abuse team, because it was obviously reported and acted on immediately. End of.
