Hi Ann, just seen your reply. We have a lot of estate agents in town, so when we decided to put the house up for sale, we had a few estate agents to give us a valuation, and thought that this one seemed the best.
I also thought that the clause was pretty general, so can't understand why the estate agent didn't mention it to M and her OH......in fact I'm fairly sure that estate agents have to tell the vendor about the clause, once the vendor has decided to use them as their selling agents.
As you said, to sell our property is worth more to them, than the amount they would have got with us taking it off the market earlier. Maybe they thought they could make a bit out of us if we withdrew it earlier rather later, when we wouldn't have to pay them anything.
It's twenty years since we moved to this house, and a lot of things have changed with estate agents since then. Time was, we could withdraw the house off the market anytime and not have to pay anything at all. It was only if they sold it, that you would have to pay.
I haven't had time to look at that site yet, but will look at it in a while. Thanks Ann.

Is the clause you are thinking of a sole agency clause? If so that is pretty general, but I suspect that somewhere you could find where it says theya re contracted to send interested people to you. Actually it is stupid and may be just inefficiency on the part of a clerk because to actually sell the property is worth more to them than you'd have to pay for taking it off the market surely.

Sally is this the only estate agent in your area?
I am not sure what the law is but there is one to do with professionals giving misleading information. Maybe your neighbours should look into that and maybe ask the advice of the CAB. Good job you realised though. And I didn't know theyw ere allowed to have such a clause.

Caz, thanks for letting us know about Jean. I hope she didn't hurt herself too much......even if she didn't, it must have shaken her up a good bit. Sometimes after a fall we don't always feel all the aches and pains until the next day, so lets hope that Jean will be alright to go out tomorrow.
Sylvia, it's good that the insurance assessor is sorting out your claim, so hopefully you'll receive the cheque very soon.
Glad to hear that OH's jaw is feeling easier now......he's brave having all that work done at the dentist. I just wish I had his courage and wasn't as terrified as I am.
Ann, the estate agents probably thought that we wouldn't find out about how much trouble the couple had to go to get an appointment to view our house.....of course this was all going on when the estate agents themselves were trying to persuade us to take the house off the market, so that they could make a bit of money out of us. Alun and I are pleased knowing what we know now, that we stuck to our decision not to take it off the market. I think they hoped that we would have forgotten about having to pay a fee if we took it off before the given time.
Some neighbours further down the road put their house up for sale with them at the same time we did. After five months, with no one viewing it, they took it off the market, not realising that they would have to pay a fee. The estate agent hadn't told them anything about the 'clause' (for the want of a better word) but of course, they were adamant that they did.
We know those neighbours quite well, and I know who I believe. I just feel sorry for them, M has health problems and they are trying to get a bungalow to be near their youngest daughter who has cancer.....her and her husband live about 8 miles away.
Sorry to go on , I'm mad about the whole situation. But our time will come, I'm just waiting, biding my time.

Pleased that your OH eventually got home Sylvia and I hope his mouth is settling down now. Also hope you soon get your cheque.
Good to hear from you Marie, we have been thinking about all the problems there and feeling so sorry for everyone. your fancy dress party sounds fun, glad it all went OK.
Sorry to hear about Joyce's further bad news and sending lots of positive thoughts for the biopsy.
Thanks for letting us know about Joyce Caz. And now Jean as well. Hope the bruises are not too painful. Must take more water with it love!!! No, mustn't joke I am sure you will be feeling sore.
Mo The car was fixed by an auto electrician who came out to us. It took him 2 hours, he took the alarm out completely, wasn't over complimentary about those sort of alarms. He also said that one of the wires was wired up wrong and had probably been like that a long time. The problem with the brake lights was caused by the switch under the brake pedal (and no I didn't know there was one there either!). Anyway only cost us £65. All fine now.
Sallie, that is disgusting about the estate agents and I would be taking it up with them too. I hope the couple can soon sell their house and you can find a bungalow.

Thats brilliant Sylvia,gaining back more than you paid for the generator originally. Are you still going to hire another one, if and when you do go to the cabin again. Oh my word, it sounds like your OH was in pain, taking all those meds. The work he is having done is all completely unknown to me. I would only assume that,that type of work over here, would be done in hospital. I don't know if our NHS dentists, would be capable of doing the work, it would probably come down to a dental specialist at the hospital. Bye for now, love Mo xxx

It's lovely and sunny, if a bit chilly, at the moment. But THEY are saying it will cloud over and rain by tonight ...... that means it will become warmer!
OH arrived home on Monday .... apparently he had decided to walk downtown after his treatment was over, that's about a 30 minute walk from where he was. Then he took our version of the Tube home, but stopped off at the barber's shop ..... where he sat and waited nearly an hour to get his hair cut! He had not had any lunch.
He cooked up some soup immediately he got home, and then later he made porridge for his dinner, and I cooked up something from the freezer for me.
OH did take a Tylenol+codeine soon after he got home, and before he went to bed ..... which means his jaw must have been feeling uncomfortable. But he says he's feeling fine now.
Mo ............. the blood typing is done (at least by this dentist) every time he is going to do the preliminary work for an implant. That preliminary work involves a bone graft, and the bone comes from cadavers .............. so I guess they have to be very careful about tissue typing.
We are waiting fro the cheque for the generator ......... the assessor talked to me on Tuesday, and there were 2 options. The first was they would issue the cheque in the name of the store where we got the quotation from, and that would include the amount of HST (ie, your VAT). The store is in the town closest to the cabin, and I pointed out that we would not be going up there until May or June ...... so he offered to issue the cheque in our name, cost of replacement minus the HST. When we buy the generator, we can go back to the insurance company and get re-imbursed for the HST.
They are paying us a lot more than we paid for the generator 5 years ago ........... but we do have Replacement Value insurance, and prices have gone up. We'll get close to about £1200 back

Good evening everyone.
Thank goodness you are o.k Marie. We were starting to worry about you again. Yes I know we are all worry guts, but it's because we care about each other. Did you take any photo's of your son in laws birthday bash. It would be great if we could see a photo of you done up as a Bavarian Fortuneteller.
It's better to have over catered, than under catered, you would never have forgiven yourselves, if you had run out of food,and people had to do without.
Hows your water aerobics going, do you still attend.? And do you still go to the gym.? By the sounds of it, I doubt very much that you would be going, judging by the heatwave you are having at the moment. The heat certainly knocks the life out of you doesn't it. Well it certainly does me. Not that I have a lot of get up and go at the moment, I think it got up and went.
Caz, special prayers are going out to you,Joyce and her grandaughter. Thank you for letting us know,whats been happening. It never rains for poor Joyce, it pours. We will miss seeing her posting, just as we miss you, when you are unable to post for a few days. I hope you are coping with your teatment,and that it's not knocking you out to much.
Sallie, I have a vision of a poor postman knocking on peoples doors, trying to find Julia. I can't believe your estate agent. Fancy not promoting your house more than he has. It's money for old rope as far as they are concerned isn't it. They are not sending people to view, with the idea that people will take it of the market, so that they earn more cash, nasty thats what I call it.
Sylvia, hows your OH feeling now, after all his dentistry work. I have never heard of them doing bloods before they commence implants. Did he need to have a transfusion afterwards. How much more work does he need before it is completed. Have the insurance company coughed up the money for the generator yet.
Huia, how the devil are you love. How is your Phil doing these days. Thank the lord that the fleas have finally gone. The little blighters had made themslves at home in your place, and didn't want to leave you. Any more sightings of your friendly rat lately. I do hope they have left you alone now. As much as you enjoy company, theres is not the type of company you need. lol
I wonder how Ann and T are faring. And if they have got the car sorted out yet.

Hello girls, I had a pm from Jean to say that she had fallen this afternoon, she bent forward to put something in a drawer in her room and sat back on her chair but it moved and she fell. Poor love is coming out in aches and pains now, she will be sore tomorrow, she hurt her knees so I hope she can walk tomorrow as she has to go out. Sending you gentle hugs Jean although I doubt you will see them for a couple of days. Sallie you do help Joyce a lot, she was telling me this morning how much she enjoys your phone conversations, we forget sometimes that she lives in a country where she doesn't speak the language so she only has Jan and his brothers and their wives to talk to and it's just usually Jan. There are four or five of us who talk on the phone regularly and she looks forward to it. I would be falling out with that estate agent, he doesn't seem to be doing a good job of selling your house, I'd be tempted to change the agents but I know there will be reasons why you can't. I've had a terrible day with my back but had to do the washing, hope it's a bit easier tomorrow. If you are referring to chemo side affects it will most likely build up and get worse, I have been given some tablets to counteract the sickness, never been given them before, but there again it's never affected me like this before, lol.

Hi Girls,
Marie, it's lovely to hear from you and to know that you and your family are safe......I feel so very sorry for all the people in Oz that have lost so much, especially any family and friends, it's such a tragic situation.
Pleased that your SiL's birthday party went off so well, I bet he was thrilled about it.
Oh Marie, I don't know how I would cope with your very hot weather, I hide in the house when it's hot here with the fan on......and the temperatures here are not as high as you get them there, as you know.
Caz, nice to hear from you, and thank you, for letting us know about Joyce. I just wish there was something I could do to help her.
I hope and pray that all will go well with her grt granddaughter's kidney biopsy next week. Joyce said that she has to come down to Nottingham Uni Hospital for that. Jennie is under a Consultant from there, and they look after her really well, as I'm sure they will look after Joyce's grt granddaughter.
This is the first house that we haven't sold straight away too, Caz. To be honest, I can't see it being sold for a good while either, the way things are at the moment. The couple that came to view it yesterday, told us that it had taken them nearly two months, on and off, to get the estate agent to make an appointment so that they could come and see it, they were promising to ring them back, about it, but didn't.
Both Alun and I are not happy about that, because a couple of months ago, they were trying their best to get us to take the house off the market, because they said there had been no interest in it at all.
The agreement was that if we pulled out of the sale before a certain date, they would be able to charge us a fee, but after that date we could pull the house off the market without being charged. But we decided to leave it on because at the end of the day, we would still like a bungalow.
Hope you are having a better day today, and that the side effects are wearing off.
Our tea is ready, so had better dish it up. I might see you all later.

Marie I was worried about you because of all that's happening over there, glad your ok. Just been talking to poor Joyce and she isn't very good, she seems to have one problem after another, her granddaughter is going into hospital next week for a biopsy on her Kidney. Can we all send positive thoughts out to her and hope it's a good result, she also says to let you all know she won't be on here for a while, Sallie the first house we sold went in the paper one day and the next morning the estate agent rung to say a young couple had been to see it and wanted to buy it, wish you could sell as quickly. Arthritis in fingers is making it hard to type so will leave it at that. Hello to everyone.

Dear friends, I am sorry to have worried you all but I have been snowed under with many commitments and not enough time, also the heat has really knocked me for six.I have been Watering the garden late at night then again early in the morning, and not sleeping very well.
We had a large Birthday party for Brian my son-in-law on Saturday night it was a costume party and the costume had to Start with a B Kathleen his wife and Barbara and I spent days cooking the meats then On friday Hours slicing the meats. The Saturday ,Barbara and I made all the Salads etc.then at 5 pm we had one Hour to get the girls ready shower ourselves and dress up in our costumes for the 6pm start, I went as a Barvarian fortuneteller, Barbara went as a Buxom Pirate the girles as Ballet dances. A good time was had by all, and as all good Aussies do, we overcatered , luckly like good Aussies we all have a freezer also an extra fridge in the Garage for parties and such so all the extra food came home and into storage and we will be eating it for some time.
I was sad to read that you Dutch had such a bad day and are in so much pain also sorrow for your lost loved ones. God bless you Joyce I wish there was some way I could help you, I will be Praying that you get some relief.I am thinking of you. A Gentle (((hug))))for you. Caz I hope you are coping with the chemo, and it stops that insideous horrible C .Thank you for thinking of me and I am sorry to have worried you I am well just so tired from all the heat and upset for all the lives that were lost in our terrible Cyclone Floods and now all the bushfires.
So many people have lost so much, things that they can never replace,I am praying that the--- Almighty Lord ------will allow us some peace I am sure we all need it, especially all our,Service men and women Fire fighters ,Search & rescures people Doctors Nurses and the thousand of Volunteers and especially all the Gov.employees who have been working such long Hours and too all those who have lost family and friends. Hi Mo, just seen your post, I feel so sorry about your friends granddaughter, those fits are horrible things and very frightening. Two members of my family suffered with them when they were children, but did grow out of them eventually. Her poor grandparents must have been besides themselves with worry, and especially not being able to make themselves understood.
I hope she'll be alright and that she will stop having them as she gets older, bless her.
I've written a short letter to Julia, so I'll post it tomorrow, and hope the poor postman will be able to work out where he has to deliver it to.lolol!! Poor chap.

Hello All,
I've had a busy day today, first of all went for a hearing test, then we went and done the weekly shopping, it was very quiet in A--a's, nice for us, because we got the shopping done a lot quicker. And then cooking our dinner, oh I didn't feel like doing that.....but needs must.
I've also been trying to find out how Julia is, it's such a long time since she's posted, and there are quite a few members on GR that are concerned about her, including myself. So I'm going to do what Liz Purple has suggested, and write her a note, with as much information on, on where she lives on the envelope and post it to her, and hopefully she will receive it. Just hoping that the post man will know who it's meant for. Well it's worth a try, at least, and I'll put my return to sender addy on the back of the envelope, just in case.
Where is everyone? It's very quiet on here, as well as a lot of other threads.
Mo, I was reading the Friendly Thread, last night, I sat here laughing at some of the things that were said, I'm sure if someone had heard me laughing like I was, they would have 'wondered' about me It's a lovely thread everyone is so cheerful, even with the problems some members have.
Have you heard anymore about your nephew, it seems a while since you last heard. Sending him lots of positive thoughts.
Ann, the hearing test went OK, thank you, by what I told him and the results of the test, he thinks that it is something to do with some three small bones in my ears, that are hardening, but to know for certain I would have to go to see an ENT Speciallist. I'm not too keen on that idea.
He took a mould of my ear, and I have to go back to see him in 3-4 weeks time for the hearing aid, if it fits OK.
He also told me that if I have got what he thinks it is, then it is hereditary, but it can skip out a generation. I've had some loss of hearing in my right year since I was about twenty seven, and over the years it's got worse and now I also have loss of hearing in my other ear too.
Joyce, if you're looking in, I hope you are feeling a bit better and not so upset as you've been. Take care of yourself.
Jean, I hope that horrible vertigo has gone for a while again, and that you are able to get on with your crafting. Hope J and D are both alright.
Sylvia, hope all is well with you and OH, and that he isn't feeling too many after effects after the dentist. Hope you are still having good weather.
Huia, did you meet the lady that's going to do your book for you, I hope you had a good meeting with her. Hope all is as well as it can be with Phil.
Marie,I hope you and your family are are all OK. It's a while since we heard from you. Take care.

Ann thanks for the good luck wishes....I'm hoping they will be able to sort me out, too. I'll let you know how later today, how I get on.
Joyce, what are we going to do with you.lol! I know you are worried and concerned about your friend, but I agree with her son and Ann, you or no one else can make her go to the doctor's until she's ready to go herself. I don't want you to think that I'm hard or unfeeling because it's not meant that way at all, but you are going to make yourself really ill over something that you can't do anything about.
You have to think about you and Jan now, you have each other and you should be enjoying life together, so please stop worrying about other people.
I'm really sorry that you couldn't find the grave so that you could put the flowers on it. You were bound to get upset seeing the photo of your daughter , Joyce, it's early days yet, and it's the first time you've been to Liverpool since she died.
We are all here for you, and you know that we'll help you if we can, any time you need to talk.
I'm going to have a shower now, so that I can get ready to go for my hearing test.

Joyce, what a trip you had!! So sorry you couldn't find the grave. Was it that you had forgotten where it was. Isn't there anyone at the cemetry who could have helped you? And, as to your friend, you can't make her go tot he dentist and, although you are obviously worried about her you really have enough to worry about for your own pain. I am sure her family will help her deal with her problems. That isn't meant to be hard but you have to think of you and Jan.

Goodmorning Ladys Just short message and Caz i dont mind you putting it up ,had bad day on monday first my son was showing me photo of my daughter and i cried knowing she wont be here anymore ,then wnt to the grave of my mum and dad and grandaughter but could,nt find find the grave just stood there and cried no were to put the flowers,my son is going back again with his girlfriend to try and find it,and if that was,nt bad enough i think my best friend is getting parkinsons but she wont have any of it said its her nerve tablets .but i notice her shaking has got worse what can i do i told her son but he said you cant make her go the docters but my son son told me mum your going to be ill if you keep worrying over her but shes my friend of 46yrs sorry will have to go crying again Dutchx

Sylvia, hope OH has arrived home by now.....gosh it's a long job, but I'm sure he won't regret it when all the work has finished. He's very brave having all that work done, I really admire him, as I'm absolutely terrified of dentists. Have been ever since having a bad experience there when I was in my late teens.....many moons agolll!!
Hope you are alright Sylvia. Sounds as though spring is on it's way in Vancouver. But I must say it has been quite springlike here today too.
Best not to speak to soon, as it will more than likely change again, as we're only a third way through February yet.
I go for my hearing test tomorrow at twelve, so we shall see what they say.
