Who benefits from Probate?

Question - Who last saw the Will When did it vanish - before or after the rellie's death?

Hang on, I'll be back to you in a mo when hubby's dictated it to me in shorthand! Yeah, just like the Docs marry their Nurses, the lawyers marry their Articled Clerks! Must work, we've been together for 42 years! Cherry

A friend of my parents left no Will, he was married but it still had to go to probate. They deside who it the lawful next of kin/kins and then they get the estate. If no one claims then the goverment get it. It took a while but his wife got everything in the end, good job she had sons with good jobs to lend her money to pay the bills as the joint back accounts were frozen until it was settled. She was allowed to stay in the house until it was settled. Point being..........MAKE SURE YOUR HUBBY HAS A WILL

If there is no will, the law states how the money has to be divided up: a set amount to the spouse, any left goes to children, and then down a line of relatives. If there is no will, you have to apply for 'Letters of Administration' instead of probate. Monica

Oh, so there were family to claim then? I thought you meant with no family and no will. Why dont you change the heading to something like - Will Vanished - who benefits from property? You may get one of the legal sleuths notice.

Thats what the ads in newspapers telling us to make a will lead me to believe! It may be an advertising ploy. There must be a legal eagle on here somewhere.

Hi If Probate isn't applied for, reason unknown but it involved a huge amount of property, businesses included, who benefits? How is the property then sold? What happens to the money? Thanks Lisa
