HeyJude, yes you have come to the same conclusion as myself.
With all our research etc., we also beleive that she was Robert and Janes daughter.
1. Jane and Emily snr were sisters.
2. David Claxton and Robert were stationed down Chatham at the same time.
3. Young emily recalled coming down on a train from Northumberland with a sick lady (possibly jane)
4. Why this child Emily Kirton??? did she become Emily Claxton and was given the same christian name as her so called adoptive mother.
5. Enigma!!! when the claxtons passed away for some reasons??? Laura (half sister to Emily Jane) and her family destroyed certain papers and we dont know why.
6. Have sent for certificate for mary kirton - but no not the one.
7 It has to be a child on BDM but it is eliminating each one to which i have tried to do, and have crossed check even the parents of each child to see if possibly linked to the Kirton family.
8. Due to Robert injured in war, could Jane have had an affair??? all this we will never know.
9 Robert did re marry and have a son, and on a recent search found that this sons wife is possibly still alive, but would be unable to give us any info i think.

Thanks for your help and time, unless you would like to research further!!

It is unlikely she is anything to do with any of Robert's siblings because she is with Jane's family so I would say she is undoubtedly the daughter of Robert and Jane. But like you I have not found a regsitration that would fit in the name of Kirton/Kerton/Kearton, Claxton or Woods. Nearest was one for a Mary Kirton

accept what you are all saying, but have for the last couple of years searched and searched again. No record of a birth for an emily claxton, only one is 1901 in norwich. we genuinely believe that she was the child of robert and jane but WHAT name was she given. On her so adoptive fathers army papers its shows that he is requesting extra pay for an adoptive daughter born with the same date and area of birth.
I know we could send for ALL birth certificates for this would be very costly, i have tried to eliminate if she could have been the daughter of Roberts siblings but couldnt find anything there.

Jonesey Report 8 Jul 2012 17:13

Formal adoption did not begin until 1927.

If the young lady knew who her biological father was then she most probably will have named him at the time of her marriage. Of course if she did not know who her biological father was then whatever is on the marriage certificate cannot be taken as being conclusive proof. Catch 22 I'm afraid.

Only her birth certificate will name her father or indeed name the man her mother chose to name as the child's father.

Following PM...

1911 census has Emily Kirton "niece" of Emily Claxton. Emily Claxton is Jane Pricilla's sister as is Laura Woods also on census.

Tree on A has Emily May Kirton daughter of Robert Kirton and Jane - no sources...but birth 09.03.1902 death 11.05.1975 which comes from this

Name: Emily May Bagley
Birth Date: 9 Mar 1902
Date of Registration: Apr-May-Jun 1975
Age at Death: 73
Registration district: Birmingham
Inferred County: West Midlands
Volume: 32
Page: 1539

what I posted earlier in Q3 1922 is her marriage to Mr Bagley - she married as Claxton rather than Kirton

She was undoubtedly Robert and Jane's daughter....and possibly Jane died before 1911 census...but cannot find a birth registration for her. And whether she was then formally adopted - who knows. Would guess marriage certificate will show her father as Emily Claxton's husband - maybe worth a punt?

Hey Jude, that is correct although not myself on ancestry.
It is another side of the family to which they are researching also.
reason for - unsubstantiated - emily kirton, then went onto emily claxton
then wed into name of Bagley.
Still no actual proof to whom she really was.

we beleive a child was born 1902, and on census shows emily kirton neice from northumberland.
Janes sister was Emily Claxton living in Birmingham.
this child was reared by Emily Claxton snr as emily claxton jnr.
Who was emily kirton?? born 1902 in northumberland - hence the reason for beleiving was jane and roberts child, but records of a birth with that name cannot be found.

In 1901 in Byker with no children.

So maybe the period you need to be looking at is between 1901 and 1911...which sister in 1911? Can you post that census?

brummie46 Report 7 Jul 2012 19:23

HeyJude, she died in 1911 (June qtr) and although her maiden name was woods, it looks like roberts sister married a wood by coincidence.
Robert went on to wed someone else a few years later.
Reason for trying to find where robert was from 1900-1901 for we beleive he and Jane had a daughter, but CANNOT find any trace of birth, although a child is registered staying with Janes sister on 1911 census - totally baffled cant seem to find identity of this child at all, quite a few members on this site have searched also.

Casualty details: Wounded on 10 Dec 1899 at Stormberg (1) (Official casualty roll location: Stormberg)
Source: South African Field Force. JB Hayward & Sons
Gazetteer:
[3126: 3118-2616] a post office and railway junction in the Cape Colony (Molteno district; Eastern Cape), 13 km north of Molteno. On the eve of the outbreak of the war, the junction was garrisoned by half the 2nd The Princess Charlotte of Wales's (Royal Berkshire) regiment and on 20 October 1899 reinforced by 350 marines and sailors from HMS Doris with two 12 pdr naval guns. With the invasion of the Cape Colony by Orange Free State forces, the garrison was ordered to withdraw on 3 November. Occupied on 26 November, the junction was held by some 1,500 burghers under Senior Cmdt E.R. Grobler comprising the Bethulie (Cmdt F.J. du Plooy), Smithfield (Cmdt J. Swanepoel), Rouxville-Zastron (Cmdt J.H. Olivier) commandos and rebels from the Albert and Burghersdorp district (Cmdt L.P. Steenkamp). On the evening of 9 December, a column under the command of Lt-Gen Sir W.F. Gatacre left Molteno*, the 2nd The Royal Irish Rifles leading the infantry followed by the artillery and then the mounted troops. The guides, however, lost their way, underestimating the distance from the rest stop to the Boer lines, and as dawn broke the column suddenly came across Olivier's laager which was unaware of the British presence until the last minute. The burghers scrambled to cover the crest of a ridge which overlooked the column whilst the 2nd The Northumberland Fusiliers deployed quickly to attempt to try to climb it. This attack failed and the Fusiliers were ordered to retire. Gatacre ordered a withdrawal to Molteno which was reached without major incident that morning. British losses were 28 killed and 51 wounded, whilst the Boers lost eight killed and 26 wounded; the British, however, left behind 634 officers and men to be taken prisoner. After passively occupying the junction, Boer forces began to withdraw on 3 March 1900 and, when withdrawal was completed two days later, it was occupied by Gatacre on 6 March. Pat,

Chatham was mainly a naval base so could he have been in the navy rather than the army.

A copy of his marriage certificate should give you his occupation when he married.

Please would anyone be so kind to see if they can find army records for a Robert Kirton born 1873. He was born in Northumberland but do know that he was stationed in Chatham Kent to which he wed a jane woods.
Believe that this couple had a child but can find no records whatsoever.
If we can ascertain to where robert was between 1900 and 1903 this might be able to clarify other matters.
Any help you can give would be much appreciated.
thanking you
